1. DESCRIPTION: The “Leap Day Scavenger Hunt Sweepstakes: March 2024” (the “Sweepstakes”) offers eligible participants (each a “Participant” and collectively the “Participants”) the opportunity to participate in an online scavenger hunt and upon completion of that event, be entered in a random drawing for a chance to with the prize described herein. By participating in the Sweepstakes, each Participant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of the Sponsor of this Sweepstakes, Truth Initiative, 900 G Street, NW, Washington, D.C. 20001 ("Sponsor") and the Administrator of this Sweepstakes, Moonrock Agency LLC, 8 The Green, STE R, Dover, DE 19901 ("Administrator").

2. ELIGIBILITY: The Sweepstakes is open to legal residents of the 50 United States and the District of Columbia who are between eighteen and twenty-four years of age. This Sweepstakes is void in Puerto Rico, all U.S. territories and possessions and where prohibited by law and is governed by US law, and it is subject to all applicable federal, state and local laws and regulations. Unless otherwise stated herein, Employees of Truth Initiative (“Truth”) and its affiliates, subsidiaries, parents, advertising, promotion and fulfillment agencies and members of the immediate family or household of each, are not eligible to participate. Immediate family member is defined as a parent, sibling, or any person residing in same household as the employee. Truth Initiative will be referred to herein as “Sponsor.”

3. ENTRY: The entry period for the Sweepstakes begins at 8:00am ET on February 29, 2024, when the scavenger hunt goes live and ends at 12:00pm ET on March 1, 2024 (the “Promotion Period”) to accommodate for any alternate method of entry. To qualify to enter the Sweepstakes, you must first participate in our first-ever Leap Day digital scavenger hunt, hosted on Sponsor’s Discord server entitled “Truth” (the “Discord”) that will feature several Discord channels titled “#announcements” and “#scavenger-hunt.” On February 28, 2024, the “#announcements” Discord channel will feature an event announcement that will drive users to the “#scavenger-hunt” Discord channel which, in turn, will feature a detailed description of the scavenger hunt event, including process and procedure, as well as these official rules and a link to a clickthrough Google form that will go live at the start of the scavenger hunt event on February 29, 2024 at 8:00AM ET. Submission of a completed Google form, per the event instructions provided, will qualify the scavenger hunt participant for entry in the Sweepstakes.

Once the scavenger event goes live on February 29, 2024, at 8:00AM ET, an individual will be prompted within the “#scavenger-hunt” Discord channel to complete a series of tasks and submit photographic or other proof of such task completion (where applicable) to the Google form linked within the “#scavenger-hunt” Discord channel.  Prompted tasks may include things like the following, through this list is not intended to be exhaustive:

• Submit your favorite comfort food recipe;
• Share a screenshot of you playing/winning Fortnite with friends;
• Share your favorite song to listen to while gaming;
• Find and share an interesting fact you didn’t know about Minecraft;
• Show you playing as your favorite fighter in Tekken 8;
• Check out thetruth.com and tell us something new you learned.

Once the required number of prompted tasks have been completed, the participant shall be deemed to have entered the Sweepstakes and will be entered automatically in the random drawing for a chance to win a truth Cooldown Crate (described below), regardless of whether or not that individual participates further in the Discord. Only individuals who actually join the Discord, who participate in the scavenger hunt event, and who complete the prompted tasks with adequate proof posted to the Discord as instructed will be entered in the Sweepstakes.

Alternative Mail-in Method of Entry: To enter without completing the steps outlined directly above, hand print your full name, complete home address including zip code, home telephone number with area code, e-mail address (if available) on a 3"x5" card, and mail it in a first class stamped envelope to Truth Initiative; Leap Day Scavenger Hunt Sweepstakes, Attn: Sarah Freeark, Truth Initiative 900 G Street, NW, Washington, D.C. 20001. Each such card must be mailed individually. No photocopies, facsimiles or mechanical reproductions of cards shall be permitted. No metered mail will be accepted. Envelopes must be postmarked by 12pm ET March 1st, 2024, and received by Sponsor by no later than 11:00am March 4th, 2024.

Limit one entry per person during the Promotion Period, regardless of entry method. The odds of winning depend on the number of eligible entries received. No responsibility is assumed by Sponsor for lost, late, misdirected, illegible, incomplete, stolen, postage due mail, or mutilated entries or for any computer, online, telephone or technical malfunctions that may occur. Sponsor may reject any entry it believes is the result of fraud or was submitted in violation of these official rules.

4. PRIZES/ODDS: There are up to four prizes, truth Cooldown Crates, valued at approximately $620, to be awarded in this Sweepstakes. Each Cooldown Crate consists of one sweatshirt, a hand massager, a candle, a fidget spinner, and a container of clay. Prizes are not transferable, except at discretion of Sponsor. All prizes or portions thereof are awarded WITHOUT WARRANTY OF ANY KIND from Sponsor and Administrator, express or implied, without limitation. The odds of winning depend on the number of eligible entries received. ALL FEDERAL, STATE AND LOCAL TAXES, AND ANY OTHER COSTS AND EXPENSES, ASSOCIATED WITH THE RECEIPT OR USE OF THE PRIZE ARE THE SOLE RESPONSIBILITY OF THE PRIZE WINNER. For tax reporting purposes, Prize Winner must provide the Administrator and the Sponsor with his or her social security number before the Prize will be awarded. The Prize Winner may receive an IRS Form 1099 from the Sponsor for the actual retail value of the Prize for the calendar year in which the prize was fulfilled. The Prize Winner cannot assign or transfer the prize claim to another person. No prize substitution is allowed except at the discretion of Sponsor and Administrator. If a prize cannot be awarded due to circumstances beyond the control of the Sponsor and Administrator, a substitute prize of equal or greater retail value may be awarded. Limit one (1) prize per participant. Any depictions of the prize are for illustrative purposes only. Sponsor shall use all reasonable efforts to issue the prizes within sixty (60) days of winner announcement date. Other restrictions may apply.

5. DRAWING: Administrator will conduct a random drawing on or about 12:00pm ET on March 4th, 2024, and the four potential winners will be selected at random from all eligible entries received. The first selected entrants (i.e., potential winners) shall be eligible to win. Administrator shall notify all potential winners via direct message in Discord and then share required documentation by email within approximately ten (10) days of the drawing. If Administrator is unable to contact the potential winner after reasonable effort, or if one or more of the potential winners fails to respond within three days of first attempted notification, the prize may be forfeited and may or may not be awarded to an alternate winner, in Administrator’s and Sponsor’s sole discretion. Administrator reserves the right to disqualify anyone not fully complying with the Official Rules.

6. GENERAL: The four potential winner(s) of the truth Cooldown Crate(s) will be required to sign and return to Sponsor a signed Statement of Eligibility, a Liability Release, and a W-9 Form, and, where legal, a Publicity Release, within ten (10) days of first attempted notification. In the event of noncompliance, a potential winner may be disqualified and an alternate winner may be selected, at Sponsor’s sole discretion. By entering, participants (a) agree to be bound by the official rules and the decisions of Sponsor (including but not limited to eligibility determinations) which are final and legally binding in all respects; (b) agree to release Sponsor and Administrator and each of their respective employees and agents from any and all liability, loss, damage or injury resulting from participation in this Sweepstakes or awarding, receipt, possession use and/or misuse of any prize awarded herein and acknowledge that Sponsor and Administrator, and their respective employees and agents have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize including, but not limited to, its quality, mechanical condition or fitness for a particular purpose; and (c) agrees and consents to Sponsor’s use of the participant’s personal information, including without limitation, the Sweepstakes winner’s Discord username/handle as submitted by participant as described in Sponsor’s privacy policy at https://www.thetruth.com/privacy-policy.

7. INTERNET: If, for any reason, the Internet portion of this Sweepstakes is not capable of running as planned, whether due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right at their sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes. In the event of termination, random drawings to award the prizes will be conducted from entries received up until the time of termination. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Sweepstakes. CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute, entries will be declared made by the authorized account holder of the e-mail address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

8. DISPUTES: This Sweepstakes is governed by the laws of the United States and the District of Columbia, without respect to conflict of law doctrines. As a condition of participating in this Sweepstakes, participants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in the District of Columbia having jurisdiction. Further, in any such dispute, under no circumstances will participants be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental or consequential damages, including attorneys’ fees, other than participant’s actual out-of-pocket expenses (e.g. costs associated with entering), and participant further waives all rights to have damages multiplied or increased.

9. PUBLICITY: By accepting a prize, you grant to Sponsor the right, except where prohibited by law, to use your name, likeness, picture, address (city and state), e-mail address, voice, biographical information and written or oral statements, for advertising and promotional purposes in promoting or publicizing Sponsor and their products or services, without compensation unless required by law. You shall have no right of approval, no claim to compensation, and no claim (including, without limitation, claims based on invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, alteration, or use in composite form of your name, picture, likeness, address (city and state), email address, biographical information, or entry. The rights granted under this paragraph shall extend to submissions and all other submitted materials related to the Sweepstakes, including those submitted by non-winners and winners.
